Deterrence & Early Intervention

Deterrence is Medical Justice's primary thrust -- and the most important benefit of membership. Prevention of meritless cases saves physicians time and money, and mitigates stress.  Nationwide, physicians are sued at a rate of 8-10% - with Medical Justice that rate falls below 2%!  This track record sends a powerful message to proponents of unwarranted lawsuits.

To reinforce deterrence, Medical Justice operates a searchable online membership database that notifies all proponents of a meritless case that its members are backed by an organization with resources to fight frivolous claims. Awareness of the physician's membership can be enough to derail the plaintiff's initial decision to sue. If and when a physician is sued,  opposing counsel is immediately informed of the physician's membership in Medical Justice.

These additional lines of deterrence can and often do persuade an attorney to drop a meritless case, sooner rather than later. It is frustrating for a physician to suffer the indignity of an open meritless case for years before it is finally dropped. A number of Medical Justice plan members have had their names dropped from a suit in weeks as a result of the company's early-intervention strategy.

Finally, Medical Justice engages in broad-based preventive communications. The executive team is committed to expanding the company's deterrent effect on behalf of the membership.

Responsive Benefits & Strategy

Medical Justice provides a tiered structure of benefits to respond to a frivolous lawsuit. 

First, if a frivolous lawsuit is filed or a plaintiff attempts to use an unqualified expert witness, a member may bring a counterclaim against the patient in the underlying suit.  Such a counterclaim could seek dismissal of the lawsuit or to prevent the use of the unqualified expert witness in the suit. 

Second, Medical Justice will arrange for review and analysis of the medical malpractice expert witnesses' testimony provided during discovery or at trial if the lawsuit was terminated in favor of the member.  If this analysis determines that the expert witness violated any of the guidelines or codes of conduct for their professional agencies or societies, Medical Justice will file and pursue a complaint against the expert witness with the respective agencies or societies (in its own name) whenever permitted. 

Third, if a lawsuit has been terminated in favor of a Plan Member, a countersuit may be brought against the Patient either by the Plan Member directly or in some instances by Medical Justice through an assignment.   If Medical Justice accepts assignment, it will retain an attorney to fully prosecute said counterclaim within all legal and ethical boundaries in its own name and will allocate up to $100,000 in attorney's fees and expenses necessary to pursue the matter.
